    Dan Savage et al have already discovered that this is actually just another case of obama apathy, not some shocking new malice. He’s not against us, but nor is he for us, as he has been saying from the beginning.

    He allowed a Bush holdover bureaucrat to stay on gay issues, not instructed the bureaucrat to write that position. This indicates apathy, not malice.

    That’s a very measured piece. But here’s my question: does the DOJ making the full case to dismiss, instead of only asking for a dismissal on procedural grounds, hurt us?

    I suppose the fact that this story is being covered at all makes it so that the case doesn’t die without hurting us.

    I won’t let myself be worried though. We’ll win somewhere eventually.
